The MDC had expected a positive ruling that would have ended the long running battle for the release of the presidential results which the MDC candidate Morgan Tsvangirai has claimed to have won.
The opposition party has also ruled out participation in any run-off saying Tsvangirai won by about 50.3 percent, which is enough to avoid a run-off against Zanu PF candidate Robert Mugabe.
MDC had argued in court that the delay by the Zimbabwe Electoral Commission (ZEC) to release the presidential results was causing anxiety among stakeholders and Zimbabweans in general. But on the contrary ZEC lawyer, George Chikumbirike argued that the MDC’s demand before the court was not realistic and did not make sense.
An emergency Southern African Development Corporation (SADC) held in Zambia at the weekend on the electoral impasse urged ZEC to release the presidential results expeditiously.
